| Wow. I wouldn't want to win if it takes being called a liar to do it. |

I don't think that Jeff has any inhibitions about winning at ANY cost. | |

| A win? That decision reads like the court had to hold their nose to rule against the city. Didn't paint a particularly flattering picture of Harris did it? |

| Harris didn't win because he was in the right. He only got to keep some of the pages because of a technicality. Can't some of the dumb supporters of that toad read? That was the most stunning indictment of HIS corruption possible without rendering a criminal sentence. |

| When someone gets described the way Harris was that is the best tasting grapes I've found. The result is a GOOD thing for the people of Bisbee. We get to vote on theses issues. The fact is 198 valid signatures remain on RF-06-01, and 195 valid signatures remain on RF-06-02 -- more than the 169 required on each petition. |

| Would it not have been much much simpler if the city had NOT appealed Hoggatt's decision in the first place?
That way the referendum could have piggybacked on the ballot last March with the Charter Amendments, making that election a lot more cost efficient.
There was time and opportunity to put both things on the ballot and the turnout might have been better instead of the record low.
Plus, it would have freed up MacKinnon to tilt at other windmills like the appeal of the trial court decision on the Border Cities affair.
As it is, the Recorder's office still has to do its check on the signatures. I understand they were bent out of shape when MacKinnon held back the paperwork on the first go-round. |

| The city has one more try in this: Arizona Supreme Court. MacKinnon told the Review that a decision to appeal to that level was up to the council. So? What's the bet? To the Supreme or to the Electorate? |

| Supreme Court or the voters. Plenty of time. It can do both. The Court first then voting? Why not? No rush is there? |

| Read the complaints mouthed by the hysterical and then think about the facts.
Complaint: This is an expensive cost to the city.
Fact: Assuming the council even chooses to take it to the supreme court, the city attorney is on salary. The biggest expense of any lawsuit is in legal fees. There are no legal fees for the city. Filing costs and other incidentals are a comparatively small expense. Chicken feed, so to speak.
Complaint: The voters should decide.
Fact: Decide when? You can always have an election on this issue but you don't have the luxury of waiting to appeal a case or to take one to the supreme court. If you miss your chance you don't get a do over if you have second thoughts.
Complaint: This is a vendetta by the city attorney.
Fact: The decision to appeal or go to the supreme court is the councils' not the attorneys'. He works for them.
Complaint: The city never learns its lesson.
Fact: A lesson? Is that what the hysterical think? Had people simply given up on what is right we would still have Separate but Equal and that brilliant legal decision was made by none other than the Supreme Court of the United States. |

| Ordinances aside, this legal victory may spell election victory for Jeff. Especially if MacKinnon takes it to the Supreme Court.
When Jeff filed to run against Luche in ward two everyone thought it was a joke. But the visibility and publicity could pull in the votes for Jeff.
After all, who remembers why he ran in the first place? What voters will see is someone who fights hard for them, all the way to the Supreme Court (!!!), and the timing could not be better for Jeff.
If he can keep from meeting voters in person -- he's a shoe in!!! |

| What happened at the meeting tonight? Ron sounded like he was all alone in wanting the Supreme Court review but MacKinnon said nothing. What gives? It looked like the whole thing had been discussed somewhere else and this was just for show. Haven't seen a mayor make such a strong impassioned plea since Dan against beer on Vista. In that case when the vote came Dan swung to the opposition for a unanimous vote. At least Ron's vote lined up with his argument. |

| Look for the zoning laws to be passed by a majority. The court may have cut Harris a break on a technicality but the voters won't. |

| Do you really think the voters will accept the zoning changes? I question that. I think they are more interested in maintaining freedom than accepting the conformity of others. |
